　　为了加强对**水库的运行管理，使其更好地发挥作用，经甲、乙双方共同协商，自愿达成如下水库承包合同：
　　一、承包期限15年，自2016年2月6日起至2031年2月5日止。
　　二、承包费用每年40000元，每五年支付一次，每次共计200000元，（大写）贰拾万元整。（付款时间分别为2016年2月6日，2021年2月6日，2026年2月6日）。若不按时缴纳承包款，甲方有权终止本合同。
　　三、合同签字生效后，涉及本合同之前的所有纠纷和各项矛盾由甲方协调解决处理。
　　四、库面附属物，待合同签字生效后，由乙方同水库附属物所有方协商处理。水库内的养殖权由乙方所有。
　　五、乙方在承包期内严格执行并按照甲方要求配合当地抗旱、防汛和建设工程等调度用水，当地政府有权让放水人员操作放水，其他人员乱放水，乙方有权拒绝，如需放水，应提前通知乙方。乙方有权保证水面下放养生物维持生命用水。
　　六、乙方严格服从党委政府的领导和上级水利主管部门的指导。
　　七、合同期限内，乙方在考虑安全稳定、合理合法的情况下，有权自选盈利项目，自主开发有利项目。
　　八、乙方负责看护水库各种设施，搞好水库周边安全和周边群众关系，如遇天灾（非人为因素）使水库遭到破坏，双方互不追究损失和责任。
　　九、本协议签字后，原来甲方与其他人无论是书面协议或口头协议与本合同发生矛盾和冲突的，均视为无效协议。
　　十、本合同到期后，承包期内乙方新建附属物作价，同等条件下乙方具有优先承包权。
　　十一、本合同一式四份，甲方一份，乙方三份，共同遵守合同各项条款。
