事实与理由：

原告与被告为叔侄关系，均系x县x镇x村村民。原告于x年x月x日从x县x镇x村村民委员会承包涉案承包地，该地位于x县x镇x村北侧，东临王飞的承包地，西邻被告的耕种承包地，北至小路，原告自承包后耕至2007年秋收，2007年秋收后，原告因忙于店铺生意则将该承包地交由被告代为耕种，但双方均未约定代为耕种的期限，也未签订有关的协议。现原告向被告收回该承包地，但被告以各种理由拒绝返还，无奈之下，原告只能通过法律途径来维护自身权益。

为此，原告根据《中华人民共和国农村土地承包法》以及相关司法解释，提出上诉请求，恳请贵院予以支持，以维护原告的合法权益。
