　　甲方：（发包方）
　　乙方：（施工方）
　　依照《中华人民共和国合同法》、《中华人民共和国建筑法》及其它有关法律、行政法规，遵循平等、自愿、公平和诚实信用的原则，甲方决定以单价合同的方式将蛟河段部分铁路防护栅栏安装工程承包给乙方，乙方自愿承担该项施工任务。经双方友好协商，达成如下协议：
　　一、工程概况：
　　xx铁路客运专线于2010年11月动工兴建，西起吉林市，东至珲春市，途经吉林、蛟河、敦化、安图、延吉、图们和珲春7个县市。预计2014年建成。本合同防护栅栏安装工程位于该铁路的蛟河段范围之内。
　　二、工程造价：
　　本工程发包施工段面全长　　米（以实际测量为准），发包价格按米计算：60元/米。本合同铁路防护栅栏安装工程总造价计　　万元（含税）。
　　三、施工工期：
　　乙方必须于　　年　月　日进场，　　年　月　日竣工交付使用，如乙方超过工期，将承担因延误工期所带来的一切经济和政治责任。
　　四、工程质量：
　　乙方必须严格按照甲方要求，依据铁路防护栅栏设计方案安装施工，确保工程材料、安装施工符合设计要求，保证工程质量。甲方负责对工程质量和进度进行监督和检查验收。
　　五、安全责任：
　　乙方必须对施工人员加强安全教育与管理，做好一切安全防范措施，防止安全事故的发生。乙方在施工期间发生一切安全事故，均由乙方负责，甲方不负任何经济和法律责任。
　　六、违约处理：
　　乙方在施工期间应无条件地服从甲方的监督与管理，并在每月　日向甲方上报工程进度。乙方不按设计要求施工，若出现质量问题，将承担工程总造价10%的违约金。
　　七、费用支付：
　　甲方负责及时拨付工程款。按照工程进度，每完成一公里即付70%工程款，余下30%待最后工程验收合格后一次性付清。
　　八、本合同一式两份，甲乙双方各持一份。甲乙双方签字后生效，其它未尽事宜双方协商解决。
